FOIA Request Letter
(EEOC)
Summary
This letter template may be used by employers to obtain information from the U.S. Equal Employment Opportunity Commission (EEOC) under the Freedom of Information Act (FOIA). This template includes practical guidance and drafting notes. FOIA requests are helpful to employers defending allegations of discrimination or retaliation based on the federal anti-discrimination statutes enforced by the EEOC, as these requests may provide employers with valuable information to defend such allegations. This letter is intended for private employers. It is based on federal law and does not address requests for information from state or local Equal Employment Opportunity government agencies. For a full listing of key content covering EEOC and state administrative charges of employment discrimination, see Employment Discrimination Charge Resource Kit. For more information concerning the EEOC's role with anti-discrimination statutes, see EEOC Enforcement of Anti-discrimination Laws: Key Considerations.
