Exclusive Brokerage Agreements

Summary

This practice note discusses key provisions of exclusive brokerage agreements such as exclusive agency agreements and exclusive rights agreements, as well as nonexclusive brokerage agreements such as open listing agreements. In this note, all references to brokerage agreement(s) shall mean, collectively, exclusive agency agreement – lease, exclusive agency agreement – sale, exclusive right to lease agreement, exclusive right to sell agreement, and open listing agreement.
