ESTATE OF JAMES ROCK v. UNIVERSITY OF CONNECTICUT, 323 Conn. 26
Summary
HOLDINGS: [1]-The estate of the decedent did not have standing under the Workers' Compensation Act, Conn. Gen. Stat. § 31-275 et seq., to seek benefits for temporary total disability and permanent partial disability, medical expenses, burial expenses, and actual lost wages because the Compensation Review Board erred in finding that the decedent's estate constituted a legal representative under Conn. Gen. Stat. § 31-294c and had standing to sue; and the determination that the estate of a deceased employee did not have standing to pursue workers' compensation benefits under Conn. Gen. Stat. §§ 31-307 and 31-308 did not violate the estate's right to redress guaranteed by Conn. Const. art. 1, § 10 as the estate was neither a natural person nor an artificial person and, thus, it was not entitled to the protections of Conn. Const. art. 1, § 10.
