Summary
This template is an employment application that gathers information from a job applicant to allow a Kentucky based employer to determine the applicant's suitability for a position. This template contains practical guidance, drafting notes, and optional clauses. Unless required by law or business necessity, Kentucky job applications should not include questions about the following applicant characteristics protected by the Kentucky Civil Rights Act (KCRA), Ky. Rev. Stat. Ann. § 344.010 et seq.: • Race • Color • Sex, including pregnancy and childbirth • Religion • Age • Whether a prospective employee is a smoker as long as the individual complies with the employer's workplace smoking policy • National origin Ky. Rev. Stat. Ann. § 344.040. The Kentucky Civil Rights Act also prohibits employers with fifteen or more employees from discriminating against prospective employees on the basis of disability. Ky. Rev. Stat. Ann. §§ 344.030(2), 344.040. Kentucky's Equal Opportunities Act prohibits an employer from requiring an employee or prospective employee to take an HIV test as a condition of hiring, promotion, or continued employment unless the absence of HIV is a bona fide occupational qualification for the job. Ky. Rev. Stat. Ann. § 207.135(2). This template intended for private employers. The application's language has been customized to comply with Kentucky and federal law. As a result, the text of this template differs from the non-jurisdictional Employment Application.
