Employer Support Letter
(Based upon Approved Blanket L-1 Petition)
Summary
This template is an employer support letter based upon an approved Blanket L-1 petition. This template includes practical guidance and drafting notes. This template allows an employer to submit an L-1 visa petition and application by a foreign national pursuant to an approved blanket L-1 visa petition to employ the individual in either a managerial, executive or specialized knowledge professional capacity as an intracompany transferee, from a qualifying organization abroad to a qualifying organization in the United States. An employer may submit this letter to either a U.S. Consulate or Embassy abroad where the foreign national employee will apply for a visa, or to the U.S. Customs and Border Protection (USCBP) for a Canadian citizen applying for admission to the United States under the North American Free Trade Agreement (NAFTA). See 8 C.F.R. § 214.2(l)(1)(ii)(A) for the definition of an “intracompany transferee.” See 8 C.F.R. § 214.2(l)(1)(ii)(G) for the definition of a “qualifying organization.” In addition, in the case of a foreign national already residing in the United States in a valid nonimmigrant visa status who is seeking a change of status to L-1 classification, the employer may file the petition with the U.S. Citizenship and Immigration Services (USCIS) office at which the blanket L petition was filed.
