Employee Proof of Claim Form and Payments (WEPP)


Summary

This practice note discusses the Wage Earner Protection Program Act, S.C. 2005, c. 47, s. 1 ("WEPPA"), which requires insolvency professional to determine the earnings, vacation pay, termination pay and severance pay owing to an eligible employee under the Wage Earner Protection Program ("WEPP"). The WEPPA also requires the insolvency professional to provide a proof of claim form to the employee and Service Canada (see practice note: Wage Earner Protection Program (WEPP)). WEPPA also applies to employees in proposal proceedings under the Bankruptcy and Insolvency Act (Canada) or under Companies' Creditors Arrangement Act proceedings, or foreign insolvency proceedings recognized in Canada if a court determines that the employer is winding down its business.
