Employee Privacy: Deception Detection and Polygraph Administration State Law Survey
Summary
This state law survey provides an overview of how states regulate polygraph examination procedures by employers, including qualifications of polygraph examiners and voice stress analysts. While polygraph administration is regulated at the federal level under the Employee Polygraph Protection Act of 1988 (EPPA), employers must also comply with relevant state laws that address required notifications and consent, prohibited exam inquiries, and employers' ability to request or require a polygraph. For more information regarding the regulation of employee privacy at the federal level, see Employee Privacy (Federal).
