This practice note is intended to provide insight into some key employee benefits-related issues that arise in connection with reductions in force and voluntary exit incentives. Although there are many factors to consider when designing these types of programs, this practice note will highlight some of the thorny issues that arise under the Employee Retirement Income Security Act of 1974, as amended (ERISA) and the Internal Revenue Code, as amended (the IRC or Code).
