Summary
The reporter requested that a witness in a pending action in an adjoining county travel to her office where the deposition had been reported to review and sign the transcribed deposition. When the witness declined to travel to the reporter's office due to a confining illness and did not waive his signature, the reporter refused to release the deposition until a fee was paid. The trial court of the pending action ordered the reporter, on the motion of the witness's counsel, to submit the deposition to the witness at his place of employment. On appeal, the court reversed and remanded. The court determined that the reporters were subject to the jurisdiction and venue of the trial court when they voluntarily assumed the duty of reporting a deposition in an action pending in a court of an adjoining county.
