This drug and alcohol Testing Policy with acknowledgment provides a standard drug and alcohol testing policy for Oklahoma employers. This Drug and Alcohol Testing Policy (OK) has been customized to comply with the Standards for Workplace Drug and Alcohol Testing Act ("SWDATA"), found at 40 Okl. St. § 551 et seq. The Oklahoma Medical Marijuana and Patient Protection Act allows the possession and use of limited quantities of marijuana for treatment of medical conditions upon a physician's recommendation and subject to the individual acquiring a medical marijuana license. Employers may not refuse to hire, discipline, discharge or otherwise penalize an applicant or employee solely on the basis of a positive test for marijuana unless the applicant or employee: (1) is not in possession of a valid medical marijuana license; (2) possesses, consumes or is under the influence of medical marijuana while at the place of employment or during the fulfillment of employment obligations; or (3) is in a safety-sensitive job. 63 Okl.
