Summary
The individual was employed by the firm. In response to losing several senior employees to competitors, the firm began offering its managing directors the option of entering into written employment contracts by which such employees, in exchange for agreeing to non-competition covenants in the event of termination, received such benefits as guaranteed severance in the event of termination without cause. The employee rejected the first such contract that was presented to him and subsequent drafts were proposed, some of which were signed his supervisor, one of which was signed by the employee, and none of which was signed by both. The parties disagreed as to whether a binding agreement was reached. The employee took a temporary leave of absence after getting into a brawl with a former employee; shortly thereafter, he was terminated. The employee rejected the severance offer. The court held that neither side was entitled to summary judgment on, inter alia, the breach of contract claim. ...
