Summary
This desk-sharing clause, for use in an office lease, allows tenant to rent out desk space, on a part-time and nonexclusive basis, to professionals who are not employees of tenant's business. These professionals may be affiliates of tenant, clients, or service providers. This clause includes practical guidance and drafting notes. Very often this practice violates the terms of the assignment and subleasing provisions of tenant's lease. Therefore, office tenants who want flexibility to allow nonemployee professionals to occupy and share their office space should negotiate for a clause such as this to be included in the office lease. Typically such a clause would be included in the assignment and subletting section of the office lease.
