Depositions: Drafting and Serving a Notice of Deposition (GA)

This practice note discusses how to draft and serve a notice of deposition in civil litigation in Georgia courts. Under O.C.G.A. § 9-11-30(b), you must serve a deposition notice on a party witness and all other parties before the deposition to give the witness time to prepare and arrange to appear at the deposition. The Georgia Rules of Civil Procedure and Georgia Superior Court Rules set out basic information that must be included in the deposition notice, such as when, where, and how the deposition will take place. A notice of deposition is necessary and sufficient to secure the attendance of a party, whether an individual, a corporation, or the officer, director, or managing agent of a corporation.
