Summary

This notice of deposition template may be used in Ohio state court litigation. It satisfies the requirements to give every party written notice of the deposition's time, location, and recording method. This template also allows you to request that the witness produce documents under Ohio Civ. R. 30(B)(4). It includes practical guidance, drafting notes, and alternate and optional clauses. After commencement of an action, any party may seek to take oral testimony of a witness by deposition. Ohio Civ. R. 30(A). Rule 30 addresses the notice required to be given to a witness, the different ways to record a deposition, the demand for documents, the deposing of corporate agents, examination and cross-examination, and deposition objections. See Ohio Civ. R. 30(A)-(C). After the testimony has been transcribed, witnesses can examine their deposition and mark changes while providing reasons why the change is sought. Ohio Civ. R. 30(E). Depositions are not filed with the court until they are used in a proceeding, such as supporting evidence for a motion, or the court orders filing. See Ohio Civ. R. 5(D).
