Demand Under Counter-Guarantee


Summary

This template is a demand used by the guarantor bank under a demand guarantee to make a demand upon a counter-guarantor bank for a payment to be made under a counter-guarantee. This template includes practical guidance and drafting notes. Counter-guarantees are irrevocable written undertakings issued by a counter-guarantor, typically a bank local to the applicant, to secure and indemnify payment by a guarantor bank, typically local to the beneficiary, upon demand under a demand guarantee. The demand must have a supporting statement and documents complying with the terms and conditions set forth in the counter-guarantee. Most counter-guarantees include a clause making them subject to the Uniform Rules for Demand Guarantees 2010 Revision, ICC Publication No. 758 (URDG 758).
