Degraw Construction Group, Inc., Respondent, v McGowan Builders, Inc., et al., Appellants, et al., Defendants. (Index No. 6096/13), 152 A.D.3d 567
Summary
HOLDINGS: [1]-The trial court erred in denying a CPLR 7503(a) motion, filed by a contractor and its officers/employees, to compel arbitration of the causes of action asserted against them by a subcontractor because the agreement between the parties' contained a broad arbitration clause, and the officers/employees were entitled to enforce the arbitration provision inasmuch as any breach of the agreement would have necessarily occurred as a result of some action or inaction attributable to them.
