Defending Examinations for Discovery (BC)
Summary
This practice note will examine the practical considerations counsel need to be aware of when defending a witness on an examination for discovery. This note will outline the purpose of discovery and objections, the manner in which an objection is made, and the types of permissible and inappropriate objections counsel may make. In addition to practical guidance, reference will be made to the Supreme Court Civil Rules, B.C. Reg. 168/2009 ("Rules"), and other practice notes to further help counsel prepare themselves for when their client is being examined.
