Summary

This deed of gift template is commonly used in Georgia to transfer title of commercial real property between spouses, relatives, friends, or charities. It can only be used when no compensation or consideration is involved in the transaction. This template includes practical guidance, drafting notes, and an optional clause. Similar to a quitclaim deed, an owner/grantor transferring title through a Deed of Gift does not warrant title to the property. All deeds transferring real property must be accompanied by form PT-61, Real Estate Transfer Tax Declaration when submitted for recording, whether or not the transfer is exempt from payment of Georgia transfer tax.
