DOL Wage and Hour Investigations: Preparation and Response

Summary

This practice note provides guidance on avoiding, preparing for, and responding to wage and hour investigations by the U.S. Department of Labor (DOL). The DOL may conduct workplace inspections and bring enforcement actions against employers that the DOL finds to have violated the Fair Labor Standards Act (FLSA) and related statutes governing wage payments to employees. Since 2008, the DOL's Wage and Hour Division (WHD) has increased its investigative workforce by over 40%. The WHD regularly embarks on targeted investigation initiatives in addition to investigations resulting from complaints.
