DOJ and FTC Antitrust Conduct Investigations

Summary

This practice note outlines key components of civil investigations, which are conducted by both the Department of Justice Antitrust Division (DOJ) and the Federal Trade Commission (FTC), and criminal investigations, which are conducted by the DOJ, including the sources and core procedures of those investigations. While the DOJ and FTC also conduct merger investigations, this practice note covers only non-merger investigations, sometimes called behavioral or conduct investigations.
