This Customary Encumbrance Forms State Law Survey sets forth the encumbrance forms customarily and most commonly used in commercial real estate financing transactions (e.g., deed of trust, mortgage) and forms customarily and most commonly used for the transfer of commercial real estate (e.g., warranty deed, quitclaim deed) in each of the 50 states and the District of Columbia. Other forms may be permissible for financing or purchase and sale transactions; however, this survey sets forth only those forms that are most commonly used.
