Cross-Examination Request (Trademarks Office Letter)
Summary
This precedent is a letter to the Opposition Board requesting leave to cross-examine an affiant. In particular, the letter requests leave to cross-examine the Opponent's affiant and requests an extension of time for filing the Applicant's evidence. It contains practical guidance and drafting notes. Cross-examining an affiant is not mandatory however it may be beneficial to cross-examine an affiant in order to avoid the Trademarks Opposition Board accepting the other party's evidence in its entirety. In addition a cross-examination may help to obtain helpful admissions or evidence.
