Summary
The inmate requested a copy of the Manual for United States Marshals in November of 1976. The inmate brought suit in December of 1977 upon receiving no response from the Marshals. In April 1978, the Marshals notified him that it would release a copy of the Manual with certain deletions. The inmate pressed his claim for the remaining material and added a request for an award of attorney's fees based on the Marshals' release of the noncontroversial portions of the Manual. The court affirmed the grant by the district court of the Marshals' motion for summary judgment on the ground that the deleted items related to housekeeping matters exempt from disclosure under subsection (b)(2) of the Freedom of Information Act. The exemption covered those portions of law enforcement manuals that prescribed the methods and strategy to be followed by law enforcement agents in performing their duties.
