Summary
This survey addresses insurance coverage disputes involving innocent co-insureds and the severability of interest clause. The survey covers all 50 U.S. states and the District of Columbia. Many opinions in coverage disputes begin with the court's statement that its most important consideration is the language of the policy: a decision may rest on the interpretation of the difference between "any" or "an" and "the" with respect to coverage of one or more insureds. A severability clause adds to the analysis, as the intent of the severability clause is to provide each insured with separate coverage, as if each were separately insured with a distinct policy, subject to the liability limits of the policy.
