Summary

This practice note describes construction dispute resolution boards (DRBs) and their use in construction arbitration in the U.S. and internationally. The practice note considers DRBs established by contract independent of any statute. A contractual DRB is less formal than an administrative court dispute board and is conducted most often by members selected and agreed by the parties. This practice note does not discuss legislative construction dispute resolution boards that have been established by public entities to hear construction disputes.
