Consent Order for Joinder (BC)


Summary

This precedent is a consent order for joinder used after an application proceeds without a hearing and has been determined on consent of the parties. In this case, the plaintiff had applied for joinder of two proceedings. This precedent includes practical guidance and drafting notes. Rule 8-3 of the Supreme Court Civil Rules, B.C. Reg. 168/2009, sets out the procedure for desk orders, which require consent unless the matter falls under r. 8-4, applications of which notice is not required. Generally, there is no restriction on the type of order that can be made by desk order so long as the materials filed satisfy the judge, master or registrar that it is appropriate to proceed in such a manner.
