Summary

Conflict of laws involves the board principles of procedural law concerning what laws and what legal system will be utilized to resolve a disputed matter. Generally, the conflict of laws principles are utilized by a court to determine whether the forum jurisdiction (i.e., the location where the dispute is being litigated) will apply its laws or the laws of another jurisdiction that has an interest in the matter. Such issues will arise when the interests of more than one jurisdiction are involved in the controversy, such as when the contracting parties are from different states or where the contract is executed, negotiated, and/or performed in different jurisdictions.
