Complex Business Litigation Program Initial Disclosures
(NJ)
Summary
These Complex Business Litigation Program (CBLP) initial disclosures may be used by any party in a CBLP New Jersey Superior Court case. This template includes practical guidance, drafting notes, and an optional clause. The parties generally must serve initial disclosures within 14 days of the N.J. Ct. R. 4:103-2 conference unless a different time is set by stipulation or court order. N.J. Ct. R. 4:103-1(b)(1). However, a party may object during the conference that initial disclosures are not appropriate in this action and must state the objection in the proposed discovery plan. In ruling on the objection, the court must determine what disclosures, if any, are to be made and must set the time for disclosure. Id. A party that is first served or otherwise joined after the R. 4:103-2 conference must make the initial disclosures within 30 days after being served or joined, unless a different time is set by stipulation or court order. N.J. Ct. R. 4:103-1(b)(2). For more on the CBLP, see Complex Business Litigation Program Checklist (NJ).
