Summary

This checklist will assist companies with monopoly power and their counsel in assessing whether the company's conduct increases risk of liability from violation of the antitrust laws. Having a monopoly is not itself an antitrust violation, but companies with monopoly power can violate antitrust laws by engaging in business activities that might otherwise be legal for a company without monopoly power. This checklist provides indicators of monopoly power, examines conduct that creates risk, and lists precautions to reduce that risk.
