Summary

This checklist sets forth the required elements for a variety of causes of action frequently asserted in commercial litigation disputes. While the elements for the causes of action will usually be similar, the requirements may vary in different jurisdictions and counsel should therefore review the state law relevant to the client's claim and confirm what elements must be plead to state a valid cause of action in that jurisdiction. While this checklist addresses many common commercial litigation claims, it is not intended to be exhaustive and a party may therefore have other potential claims that are not listed herein.
