Summary
The tenant shall not assign, mortgage, or encumber this lease, or sublease the premises or permit the premises to be used by others, whether any of the above activities relate to all or part of the premises, without the prior written consent of the landlord in each instance. If this lease is assigned, or if the leased property or any part thereof is subleased or is used by others, whether such activities relate to all or part of the premises, the landlord may, after default by the tenant, collect rent from the assignee, subtenant or occupant and apply the net amount collected to the rent herein reserved. No such assignment, subletting, occupancy, use or collection shall be deemed a waiver of this covenant, or the acceptance of the assignee, subtenant or occupant as tenant, or a release of the tenant from the further performance by the tenant of the covenants in this lease. The consent by the landlord to an assignment or subletting or use by others shall not be construed to relieve the tenant from the consent in writing of the landlord to any further assignment, subletting or use by others.
