Chevron Reversal Impact Resource Kit

Summary

This resource kit provides an overview of practical guidance related to the Supreme Court's recent decision overturning the Chevron Doctrine, a 1984 decision that resulted in four decades of judicial deference to federal agencies' interpretations of the law when statues were broad or ambiguous. In what may be one of the most consequential decisions in administrative law, the U.S. Supreme Court decided two cases that determine the constitutionality of what had been a long-standing interpretation of federal agencies' ability to interpret law and issue regulatory guidance. See Loper Bright Enters. v. Raimondo, 2024 U.S. LEXIS 2882. The Court in this pair of cases decided on June 27, 2024, to overturn its 1984 decision in Chevron, U.S.A., Inc. v. NRDC, Inc., 467 U.S. 837 (1984), in which the court concluded that courts should defer to a federal agency's interpretation of a statute so long as the interpretation was reasonable.
