Summary

This template is a demand/warning letter written on behalf of a registered trademark owner in Canada to an alleged infringer; it sets out the infringing acts and requests an undertaking to stop such activities. This template includes practical guidance and drafting notes. A cease and desist letter is often the first correspondence with an alleged infringer and gives them notice of a dispute. This precedent assumes that the infringer is selling goods identical to the trademark owner’s goods, in association with the trademark owner’s trademark, without permission.
