Cancellation of Deed to Secure Debt
(GA)

Summary

This cancellation of deed to secure debt may be used in Georgia to satisfy and cancel a security instrument where the original deed to secure debt has been lost, stolen, or otherwise mislaid. This template contains practical guidance and drafting notes. If the original security instrument can be located, best practice is for the holder of the security instrument to mark it "satisfied" on its face and direct the clerk of court of the county in which the original instrument is recorded to cancel the deed to secure debt and to enter it satisfied in the deed records. For a discussion on security instruments, see Mortgages and Deeds of Trust in Acquisition Loan Transactions.
