(BYOD) Policy Acknowledgment


Summary

This template is a Bring Your Own Device (BYOD) Policy Acknowledgment for use by an employer to ensure that employees understand that the employer owns business-related content on their personal mobile devices; that employees should not expect privacy with respect to such content; and that they may be disciplined for violating the policy. This template includes practical guidance, drafting notes, and an optional clause. This template is intended for private employers. Employers may include this policy in an employee handbook or distribute it as a standalone policy. It is based on federal law and does not address all potential state law distinctions; thus, you should check any relevant state and local laws. An employer should use a separate acknowledgment form for its Bring Your Own Device (BYOD) Policy. The acknowledgment form should be signed by the employee and placed in the employee's files. This signed acknowledgment form will also bolster the employer's position in any subsequent litigation that involves the employee's business-related use of a personal device or the business-related content on such a device.
