SONJA L. BRAY, Plaintiff Below-Appellant, v. L.D. CAULK DENTSPLY INTERNATIONAL, Defendant Below-Appellee., 748 A.2d 406

Summary

The appellant filed this appeal from a superior court decision, which granted summary judgment to appellee on appellant's complaint alleging libel, defamation, and breach of contract. Appellant, a former employee, alleged that appellee, former employer, had maintained incorrect criminal history information in appellant's personnel file. The court held that it was undisputed that the allegedly defamatory information contained in appellant's personnel file was never published to a third party. Accordingly, the superior court did not err in granting summary judgment to appellee on the libel and defamation claims. Furthermore, the employee handbook, which does not set forth terms, conditions, or duration of employment, did not constitute a contract.
