Biometric Privacy State Legislation Tracker (2025)

Summary

This tracker covers proposed state biometric privacy legislation introduced after Jan. 1, 2025. Biometric privacy law proposals are undoubtedly on the rise. While states with comprehensive privacy laws generally provide some level of protection for biometric data as "sensitive information," states are increasingly proposing bills closely modeled after the Illinois Biometric Information Privacy Act (BIPA), 740 Ill. Comp. Stat. Ann. 14/1 through 14/99. The scope of this tracker is state biometric privacy laws applicable to private entities like BIPA. This tracker is reviewed on a weekly basis and updated as needed.
