Bankruptcy Jurisdiction


Summary

This practice note discusses a bankruptcy court's jurisdiction to adjudicate bankruptcy and related matters. Bankruptcy court judges do not possess the powers of federal judges appointed under Article III of the U.S. Constitution. Federal judges appointed under Article III are empowered to resolve numerous issues and such matters generally cannot be removed from the purview of Article III judges. Bankruptcy judges are authorized by the legislative branch under Article I of the U.S. Constitution and, therefore, have constitutionally limited authority.
