Summary

This assignment of mortgage template may be used to assign and transfer an existing mortgage on Pennsylvania real property from the current lender to a new lender. This template includes practical guidance and drafting notes. In Pennsylvania, an assignment of mortgage must be in writing and acknowledged for it to be recorded. 21 Pa. Stat. Ann. § 623-1. The assignment should be recorded in the recorder's office of the county where the real property is located. Local counsel should be consulted because many Pennsylvania recorders have their own requirements for the formatting and/or filing of an assignment.
