Summary

This template is for an assignment of leases and rents used in an acquisition loan transaction by a borrower to assign to a lender the leases and occupancy agreements related to the mortgaged property and all rents and sums payable thereunder. This template includes practical guidance and drafting notes. This separate recordable document memorializes such assignment although such assignment may also be included in the provisions of the mortgage or deed of trust itself (subject to local law and/or custom as well as a lender's specific policy on form of loan documents).
