Summary

The American Arbitration Association (AAA) is a private, not-for-profit organization that provides a broad range of dispute resolution and dispute avoidance services for commercial, construction, labor, and consumer disputes as well as other types of disputes. Though there are many groups that administer arbitrations, the AAA is the most commonly used forum for the arbitration of construction disputes. This practice note explains the procedures for and rules governing the arbitration of a construction dispute under AAA rules, provides an overview of each step of the arbitration process, and discusses how AAA arbitrations are being conducted using video conference technology. Drafting considerations for arbitration clauses in construction contracts are also discussed.
