Summary

This template is a non-jurisdictional arbitration agreement for a mutual agreement to arbitrate employment-related disputes that features guidance to withstand challenges to arbitrability for private employers. This template contemplates using the American Arbitration Association as the arbitral organization, but parties can choose to use other organizations as well. This template includes practical guidance, drafting notes, and alternate and optional clauses. It is the template for our state Arbitration Agreements (Mutual Agreements to Arbitrate Employment-Related Disputes) and has not been tailored for any jurisdiction.
