APPRENTICE INFORMATION SYSTEMS, INC., AND DAVID RANDALL LAMP A/K/A RANDY LAMP, APPELLANTS v. DATASCOUT, LLC, APPELLEE, 2018 Ark. 149

Summary

HOLDINGS: [1]-The circuit court erred in finding that a corporation violated the Arkansas Deceptive Trade Practices Act (ADTPA), Ark. Code Ann. § 4-88-107(a)(10) (2011), because there was simply no "consumer-oriented act" as required for a cause of action under the ADTPA, Ark. Code Ann. § 4-88-113(f) (2011); [2]-The circuit court clearly erred in finding that a competitor was a consumer for purposes of the ADTPA because the corporation and the competitor were opponents in the market of selling counties' public data.
