Summary
This template is a stand-alone appointment of successor trustee for use in Texas. Use this document to appoint a successor trustee upon resignation of a prior trustee. The template may be used with both revocable and irrevocable trusts. This template contains practical guidance, drafting notes, an alternate clause, and optional clauses. A trustee may resign in accordance with the terms of the trust instrument or by petition to the court. Tex. Prop. Code § 113.081(a). Upon the death, resignation, incapacity, or removal of a sole or surviving trustee, a successor trustee is selected according to the method, if any, prescribed in the trust agreement. If for any reason a successor trustee is not selected under the terms of the trust agreement, a court may itself appoint a successor, or do so on petition of any interested person. Tex. Prop. Code § 113.083(a).
