Summary

This template is an anti-coercion statement for use by Florida lenders making commercial real estate loans to borrowers to borrow money to finance the acquisition of commercial real estate in Florida. This template includes practical guidance and drafting notes. When negotiations for a Florida commercial real estate loan begin, and prior to any formal application for loan or the payment of any fees or costs required with the filing of a loan application, the lender must notify the borrower of its rights regarding the placing of insurance. Such notice must be given to the borrower in accordance with Fla. Admin. Code Ann. r. 69B-124.013 in writing, with a copy executed by the borrower to be retained by the lender.
