Summary

This template is an amendment to a Florida revocable trust for a single settlor. An amendment may be used by your client, for instance, when your client wants to make modifications to the terms of the revocable trust agreement. This template incudes practical guidance, drafting notes, and optional clauses. A settlor may reserve the right to revoke or amend the trust in their trust agreement and/or may make changes without court intervention pursuant to Fla. Stat. § 736.0602, subject to Fla. Stat. § 736.0403. Fla. Stat. § 736.0403 states that the testamentary aspects of a Florida revocable trust will not be considered valid unless it is executed with the formalities required of a Florida will pursuant to Fla. Stat. § 732.502. Therefore, the amendment to your client's Florida Revocable Trust must be executed in the same manner as the original trust agreement because the amendment thereto becomes part of the revocable trust agreement.
