Summary

This template is an amendment to a revocable trust agreement. Use this template to amend the terms of an existing Arizona trust agreement without creating a new agreement. This template includes practical guidance, drafting notes, and alternate clauses. Most revocable trusts include provisions allowing the settlor(s) to amend or revoke the terms of the trust agreement in part or in whole. However, prior to executing this template, the attorney should review the trust agreement to ensure that the amendments being made are permissible. In Arizona, unless the terms of the trust expressly provide that a trust is irrevocable, a settlor may revoke or amend the trust subject to any limitations prescribed in the terms of the trust. Ariz. Rev. Stat. § 14-10602(A). Arizona is a community property state, therefore joint action of both spouses is required to amend, to the extent the trust consists of community property. Ariz. Rev.
