Summary
This template is an amendment to a revocable trust agreement. Use this template to amend the terms of an existing Arkansas trust agreement without creating a new agreement. This template includes practical guidance, drafting notes, and alternate clauses. Most revocable trusts include provisions allowing the settlor(s) to amend or revoke the terms of the trust agreement in part or in whole. However, prior to executing this template, you should review the trust agreement to ensure that the amendments being made are permissible. As an initial matter, confirm that the trust is not designated as irrevocable pursuant to Ark. Code Ann. § 28-73-101, et. seq. In Arkansas, trusts are considered revocable by default unless expressly made irrevocable by the language of the trust.
