Amended Claim of Lien

Summary
This amended claim of lien (Amended COL) may be used in Georgia to amend a previously filed claim of lien (COL) placing a mechanic's lien on real property to secure payment for labor, services, or materials contributed to the improvement, construction, repair, alteration, or development of the property. This template contains practical guidance and drafting notes. A COL may be amended at any time to reduce the amount claimed in the original lien. As with a COL, the Amended COL must be recorded with the office of clerk of superior court of county where property is located with a copy sent to the property's owner by registered or certified mail or by statutory overnight delivery pursuant to O.C.G.A. § 9-10-12(b) no later than two business days after the date the Amended COL is filed. If the owner's address cannot be found, the copy should be sent to the contractor, as the agent of the owner; provided however, that if the property owner is an entity on file with the Secretary of State's Corporations Division, delivery of a copy of the Amended COL to the entity's address or the registered agent's address will satisfy this requirement. If a notice of commencement has been filed with the clerk, a copy of the Amended COL must also be sent to the contractor by registered or certified mail or statutory overnight delivery at the address shown on the notice of commencement.
