Summary
This practice note discusses the different types of damages in a personal injury case. In particular, it provides an introduction to the aggravated and punitive damages a claimant is entitled to recover. Aggravated damages are compensatory while punitive damages are intended to punish the tortfeasor. Aggravated and punitive damages may be claimed in addition to any other damages resulting from the tort claim. This practice note also discusses non-pecuniary damages and their valuation. Finally, it discusses the circumstances affecting the awarding of non-pecuniary damages and how this type of damages are awarded for psychological injuries.
